The FDA says it is aware that flavored e-liquids will be popular with young adults, but that adults should also be protected contrary to the over-selling of these products by adult consumers. Based on the FDA’s warning letters, some of the e-liquids involved had no flavor; however, these were being offered for sale in candy bars disguised as a wholesome snack.
Cool Cloud Vapor had marketed its e-liquid product as a supplement and a sports drink. These statements were misleading, the FDA states, because no FDA regulatory expectations or laws exist to regulate health supplements and sports drinks. The business’s application for a non-prescription industry distribution label particularly stated that the product could be used as a dietary supplement. It was not designed for use as a sports drink or an athletic supplement, based on the FDA.
